Judge Andrew Napolitano, an RPI Advisory Board member, explains on Fox News last week that the US Congress can restrain the National Security Agency’s mass spying by cutting the NSA’s budget. “The recourse is to persuade Congress to clip the NSA’s wings by taking some of its budget away from it—and that almost happened a few months ago, and it may happen after the first of the year,” says Napolitano.

Judge Orders Google To Give Customer Data To FBI

SAN FRANCISCO — A federal judge has ruled that Google Inc. must comply with the FBI’s warrantless demands for customer data, rejecting the company’s argument that the government’s practice of issuing so-called national security letters to telecommunication companies, Internet service providers, banks and others was unconstitutional and unnecessary.

FBI counter-terrorism agents began issuing the secret letters, which don’t require a judge’s approval, after Congress passed the USA Patriot Act in the wake of the Sept. 11, 2001, attacks.

The letters are used to collect unlimited kinds of sensitive, private information, such as financial and phone records and have prompted complaints of government privacy violations in the name of national security. Many of Google’s services, including its dominant search engine and the popular Gmail application, have become daily habits for millions of people.

In a ruling written May 20 and obtained Friday, U.S. District Court Judge Susan Illston ordered Google to comply with the FBI’s demands.

But she put her ruling on hold until the 9th U.S. Circuit Court of Appeals could decide the matter. Until then, the Mountain View, Calif.-based company must comply with the letters unless it shows the FBI didn’t follow proper procedures in making its demands for customer data in the 19 letters Google is challenging, she said.

Boniek claims court lacks legitimacy

On Tuesday a former state legislator and candidate for lieutenant governor declared the misdemeanor case against him dismissed after a justice of the peace adjourned proceedings amid disruption in the courtroom.

The judge says the case is still on, just delayed.

Joel Boniek, 51, of Paradise Valley, appeared in Park County’s Justice Court Monday afternoon for a court proceeding in which he and Justice of the Peace Linda Budeski and Deputy County Attorney Kathleen Carrick were slated to set a trial date.

Boniek, a Republican, served in the state House of Representatives in 2009 as the representative for House District 61. He lost his bid for re-election when he was challenged by long-time Republican state legislator John Esp of Big Timber. Boniek also was the running mate to Pray resident Bob Fanning, who ran in this year’s Republican primary for the governor’s race. Their bid for the primary was unsuccessful.

In July, Boniek was arrested on misdemeanor charges of obstructing a peace officer, resisting arrest and fleeing from or eluding a peace officer. He has pleaded not guilty.

Prosecutors say he failed to stop at an emergency roadblock set up near his home in the Paradise Valley during a July wildfire. They say he also refused to comply with officers’ orders.

In court Monday, Boniek appeared without an attorney but with many supporters, who filled the courtroom to standing room only save for a few other citizens and attorneys who were present for unrelated court matters.

Boniek told Budeski he had concerns about the matter at hand, including whether county employees handling the case had proper credentials and fulfilled criteria required by law, he said.

“This is not the time and place to be doing this,” Carrick said to Boniek and Budeski after Boniek broached his concerns. The proceeding was simply intended to set a trial date, she said.

“Your honor, why is this woman even speaking if she can’t prove she’s (a public official)?” Boniek responded, addressing Budeski.

A Boniek supporter in the room joined in, voicing support for Boniek’s questions. Budeski told him he was out of order.

“Bulls–t, you’re out of order,” he replied.

The man kept speaking as Budeski asked for order in the court. Law enforcement officers, who had been present at the hearing since it started, approached the man, whom the judge requested be escorted from the courtroom.

For the past few weeks, I have been writing in this column about the government’s use of drones and challenging their constitutionality on Fox News Channel where I work. I once asked on air what Thomas Jefferson would have done if — had drones existed at the time — King George III had sent drones to peer inside the bedroom windows of Monticello. I suspect that Jefferson and his household would have trained their muskets on the drones and taken them down. I offer this historical anachronism as a hypothetical only, not as one who is urging the use of violence against the government.

Nevertheless, what Jeffersonians are among us today? When drones take pictures of us on our private property and in our homes, and the government uses the photos as it wishes, what will we do about it? Jefferson understood that when the government assaults our privacy and dignity, it is the moral equivalent of violence against us. The folks who hear about this, who either laugh or groan, cannot find it humorous or boring that their every move will be monitored and photographed by the government.

Don’t believe me that this is coming? The photos that the drones will take may be retained and used or even distributed to others in the government so long as the “recipient is reasonably perceived to have a specific, lawful governmental function” in requiring them. And for the first time since the Civil War, the federal government will deploy military personnel inside the United States and publicly acknowledge that it is deploying them “to collect information about U.S. persons.”

It gets worse. If the military personnel see something of interest from a drone, they may apply to a military judge or “military commander” for permission to conduct a physical search of the private property that intrigues them. And any “incidentally acquired information” can be retained or turned over to local law enforcement. What’s next? Prosecutions before military tribunals in the U.S.?

The quoted phrases above are extracted from a now-public 30-page memorandum issued by President Obama’s secretary of the Air Force on April 23, 2012. The purpose of the memorandum is stated as “balancing … obtaining intelligence information … and protecting individual rights guaranteed by the U.S. Constitution….” Note the primacy of intelligence gathering over freedom protection, and note the peculiar use of the word “balancing.”

Wiretap applications obtained by the House Committee on Oversight and Government Reform prove Attorney General Eric Holder and Assistant AG Lanny Breuer lied to Committee members when they claimed DOJ personnel knew nothing of the tactics used by the ATF during Operation Fast And Furious.

Wiretap applications are forms that must be filled out and submitted to a judge, asking permission to perform a wiretap. As these requests may only be made if all other information-gathering techniques have been tried and found wanting, the applications are completed in extraordinary detail, listing all prior methods employed by law enforcement to gather existing evidence. In short, the entire history of the efforts put forth by law enforcement during a particular case or investigation are presented in writing to the court.

According to Committee chair Darrell Issa, six wiretap applications are now in Committee possession, all presented to the court between March and June of 2010 and all having been approved by Department of Justice officials. In fact, “each application included a memorandum from Assistant Attorney General Lanny A. Breuer to Paul M. O’Brien, Office of Enforcement Operations, authorizing the wiretap applications on behalf of the Attorney General.” “The memoranda from Breuer are marked specifically for the attention of Emory Hurley, the lead prosecutor for Operation Fast and Furious.”

As a variety of names are now being floated for presidential running mates, Republican candidate Ron Paul says ousted Fox News host Judge Andrew Napolitano might be at the top of his list.

Paul was asked the question about whom he would like on a White House ticket with him at a recent public meeting, and he said, “One time somebody asked me who I’d have to consider and the name Judge Napolitano jumps right out at me.”

Photo of Ron Paul and Andrew NapolitanoWhile the audience erupted with cheers of approval, Paul continued: “But when you think about the danger of mentioning one or two means you’re not going to mention quite a few others that would certainly be qualified. That’s a great story, you know, the fact that there are a lot of people now that are well-known and well-educated and know the issues and would do a very good job.”

Napolitano’s “Freedom Watch” show was recently canceled by the Fox Business Channel, but during numerous on-air segments, Napolitano had frequent flattering remarks about Paul, while criticizing other presidential hopefuls including former Massachusetts Gov. Mitt Romney and former Pennsylvania Sen. Rick Santorum.

“There is a hunger in the land for a game changer, and Mitt Romney and Rick Santorum are not up to that,” Napolitano said in early January. “There is a need in the country for a government that stays within the confines of the Constitution, or we’ll all end up like the socialists in Europe, and Mitt Romney and Rick Santorum are not up to that. There is a rumbling in the countryside that the government should shrink and live within its means, and Mitt Romney and Rick Santorum are not gonna make that happen.”

With a giant photo of Paul on the screen behind him, Napolitano said, “Only one man remains faithful to the principles of free market and small government, to the Constitution and to personal freedom, to defending the nation without being the world’s police force. Only one. You know who he is.”

On another program this month, Napolitano asked, “What if Ron Paul is being ignored by the media not because, as he claims, he’s unappealing or unelectable, but because he doesn’t fit into the premanufactured, public-opinion mold used by the establishment to pigeon-hole the electorate, and create the so-called narrative that drives media coverage of elections?”

On the same show, the judge noted, “What if Rick Santorum is being embraced by voters who want small government, even though Senator Santorum voted for the Patriot Act, for an expansion of Medicare and for raising the debt ceiling by trillions of dollars? What if Mitt Romney is being embraced by voters who want anyone but Barack Obama, but they don’t realize that Mitt Romney might as well be Barack Obama on everything from warfare to welfare?”

Napolitano’s support for Paul is not new.

In a 2007 speech, the judge had more praise, saying, “The Thomas Jefferson of our day, Ron Paul, is one of us!”

While Paul considers his running-mate options, WND reported yesterday on a new national poll of Republicans and independents revealing Florida U.S. Sen. Marco Rubio is the top choice for the vice-presidential slot on the GOP ticket this year, despite his avowed non-interest and the fact he may not even be constitutionally eligible to hold the office, since his parents were not U.S. citizens when he was born, raising doubt about his natural-born citizenship.

The national survey of 800 registered voters by Fairleigh Dickinson University’s PublicMind shows Rubio receiving 66 mentions, more than 8 percent of the time, followed by Santorum, New Jersey Gov. Chris Christie, former Alaska Gov. Sarah Palin, Newt Gingrich, Ron Paul, Mitt Romney, Michele Bachmann and, surprisingly, Democrat Hillary Clinton.

Was Judge Andrew Napolitano cutting to close to the bone for the establishment?

The Fox Business Channel has cancelled one of the only shows on the entire Fox News network that was in any way informative or watchable - Freedom Watch with Judge Andrew Napolitano.

In a press release distributed late Thursday, the channel announced that its entire prime-time programming lineup had been changed, with re-runs of already existing programs replacing Freedom Watch.

Napolitano’s show had been airing for a year, in which time he had consistently covered major issues that other news programs would only gloss over, if they devoted any coverage to them at all.

Napolitano’s coverage of the freedom stripping National Defense Authorization Act for one was second to none as far as mainstream news output was concerned. His legal and constitutional expertise on such matters is also unrivalled.

His focus on Austrian economics and Libertarian social policy provided a much welcome alternative to the endless left/right bickering constantly played out on programming from the likes of MSNBC, CNN, and FOX News itself.

Napolitano regularly defended the free market and lambasted the actions of the Federal Reserve, holding it accountable daily for the economic crisis that the US finds itself mired in. Congressman Ron Paul was a regular guest on the show, with a host of other informative analysts who were not merely about peddling the establishment party line or representing special interests.

It is for these very reasons that many fans of the show suspect Napolitano has been axed by the corporate machine.

Regarding Napolitano’s future, Fox Business stated that the judge will be “continuing to make significant contributions to both FOX Business and FOX News” and would “be showcased throughout future programming on both networks”

“Currently one of the leading judicial analysts on television, Judge Napolitano will continue his role on both FOX Business and FOX News, providing key legal insights surrounding the growing intersection between Washington and Wall Street.” the statement read.

Linking to the press release on his Facebook page, Napolitano wrote “sad news friends, but don’t worry I’ll still be here defending liberty.”

Libertarian activist Lew Rockwell is spearheading a campaign to have Freedom Watch reinstated, writing on his website yesterday:

“If you are as outraged as I am at the cancellation of Judge Andrew Napolitano’s “Freedom Watch,” here is something you can do.”
